Version 2026-10-18 · Last updated: 18 October 2026
These terms are the agreement between your business (the studio) and us for using GetBooking. Together with the data processing agreement, they apply from the moment you create a studio. Our privacy policy explains how we handle personal data. We have tried to write these terms plainly; if anything is unclear, write to us before you rely on it.
1. Who we are, and who you are
GetBooking is provided by DUNGARD SRL, Str. Vasile Lucaciu nr. 105-107, cam. 3, et. 3, ap. 28, Sector 3, Bucharest, Romania, trade register J2016014944409, VAT number RO36736491 ("we", "us").
"You" means the business that creates the studio, and the person who accepts these terms confirms they may bind it. GetBooking is for businesses, not for personal use as a consumer. Your staff and teachers use GetBooking on your behalf, and you are responsible for what they do in it.
2. What GetBooking does
GetBooking lets you run your studio online: a website, a timetable, bookings, passes and memberships, payments, invoices, messages to your customers, reports, and optional AI assistants. Features change over time; we may improve, change or retire features, and we will tell you in advance of any change that takes away something you actively use.
You sell your classes, passes and services to your customers yourself. We provide the software; we are not a party to your sales, we do not hold your customers' money, and we are not responsible for what you sell or how you run your studio.
3. Your account
- Give us accurate business details, including your company's legal name, address and tax number, and keep them up to date. We use them for your invoices.
- Keep sign-in details safe and give staff only the access they need. Tell us at once if you think someone has got into your account.
- You can turn on, and require, two-step sign-in for your team. Staff who sign in with a linked Google account rely on Google's own security for their account.
4. Test mode
A new studio starts in test mode. In test mode you can set everything up and try it out with test payments, free of charge. Nothing is billed and no real payments are taken. When you go live, the bookings, payments and passes made in test mode are deleted, real payments start, and billing starts under your plan.
5. Plans and fees
You choose one of two plans, and you can ask us to switch:
- Monthly: a fixed monthly fee, plus the extras you use (such as SMS, WhatsApp messages or the AI assistants) at their listed prices.
- Commission: a percentage of the sales you make through GetBooking, with no monthly fee.
The fees, the commission rate, which extras each plan includes and the price of each extra are those shown on our pricing page and in your studio's billing page at the time. Each use is charged at the price it had when it happened.
The monthly fee and the prices of extras do not include VAT; we add VAT where it applies. Commission includes VAT. If your business is in another EU country and has a valid VAT number, which we check with the EU's VIES service, there is no VAT on our invoices and you account for it under the reverse charge.
We may change our prices. We will tell you at least 30 days before a change takes effect for your studio. If you do not agree to it, you can stop using GetBooking before then.
6. Billing and payment
- We bill by calendar month. After each month we close a statement with the monthly fee and priced use, and charge it to the card you registered with us.
- If your use of priced extras reaches a set amount during a month, we may bill it then, so that a large amount does not build up.
- Commission on card payments taken through your Stripe account may be collected when each payment is made; it is then shown on your statement as already paid.
- Once a statement is paid we issue the invoice and email it to you.
- If a charge fails, we tell you and try again: up to three attempts, three days apart. If it is still unpaid after the third attempt, we tell you the date, 14 days later, when your studio will stop taking new bookings and sales. If it is still unpaid on that date, it stops until you pay. Bookings already made carry on, and new bookings start again as soon as you pay.
- Fees already paid are not refunded, except where we billed you wrongly or the law requires it.
7. Your customers' payments
Card payments from your customers go to your own Stripe account, under Stripe's terms between you and Stripe. You are responsible for your prices, taxes, refunds, chargebacks, and for issuing the invoices or receipts your customers are owed, including through any invoicing service you connect, such as SmartBill. GetBooking helps with these but does not take them over.
8. Your responsibilities to your customers
- You are the controller of your customers' personal data, and we process it for you under the data processing agreement. You are responsible for having a lawful basis for what you collect, and for giving your customers your own privacy notice.
- You set your own terms for your customers, such as cancellation, refund and no-show rules, and you honour them.
- You send marketing messages only to people who have agreed to receive them, and you follow the rules of the channels you connect, such as WhatsApp, Instagram and Messenger.
- You only ask your customers for health or other sensitive information when you have a valid reason to, and only ask what you need.
9. The AI assistants
The AI assistants are optional and off until you turn them on. They can be wrong. The admin assistant asks you to confirm important changes, and you are responsible for checking what it sets up. If you let customer support answer your customers on its own, you are responsible for its answers as you would be for a member of your staff's, and you can switch it to drafts for approval at any time.
10. Acceptable use
You must not use GetBooking to break the law or anyone's rights; to send spam or unlawful messages; to sell illegal goods or services; to publish content that is unlawful, hateful or infringes someone's rights; to try to get into accounts or data that are not yours; to disrupt or overload the service; or to copy, resell or reverse-engineer it. We may remove content or suspend a studio that does this, as set out in section 14.
11. Your content and data
Your content and data, such as your texts, images, timetable, prices and customer records, remain yours. You give us the right to host, copy, display and process them only as needed to provide GetBooking to you, including showing your website to the public. You confirm you have the rights to the content you upload. You can export your customers and bookings from the admin.
GetBooking itself, including its software, design and templates, remains ours. You may use it while these terms apply.
12. Availability and support
We work to keep GetBooking available and secure, and to fix problems quickly, but we cannot promise it will always be available or free of faults. We may carry out maintenance, and we try to do it at quiet times. We back up the database every day. We help with questions and problems by email.
13. Liability
- Neither of us is liable to the other for indirect or consequential loss, such as lost profits, lost business or lost goodwill.
- Our total liability to you in any 12 months is limited to the fees you paid us in those 12 months.
- These limits do not apply to loss caused intentionally or by gross negligence, to your obligation to pay our fees, or where the law does not allow liability to be limited.
- You are responsible to us for claims made against us because of your content, your sales, or how you use your customers' data, except where the claim is caused by our breach of these terms or of the data processing agreement.
14. Ending the agreement
- The agreement runs month to month. You can end it at any time by writing to us. We bill the use up to the end, and the monthly fee for the month in which it ends.
- We can end it by telling you at least 30 days in advance.
- Either of us can end it, or we can suspend your studio, straight away if the other seriously breaks these terms and does not put it right within 14 days of being told, or straight away where that is needed to stop serious harm, such as fraud or an attack.
- When the agreement ends, your studio stops taking new bookings and sales while the bookings already made are completed or cancelled, and then closes. Before it closes, export what you want to keep. 90 days after it closes we erase your customers' personal data, as the data processing agreement says, apart from what the law requires us to keep, such as invoices.
15. Changes to these terms
We may update these terms. For a change that matters to you, we tell you at least 30 days before it takes effect, by email or in the admin, and ask the studio's owner to accept the new version. If you do not agree to it, you can end the agreement before it takes effect.
16. Law and disputes
These terms are governed by Romanian law. We will first try to settle any dispute by talking to each other. If we cannot, the courts of Bucharest, Romania decide it. If the Romanian and English versions of these terms differ, the Romanian version prevails.
